The new Courts Law essay (our first in our new home) comes from Fred Smith, Jr. (Stanford) reviewing Curtis Bradley & Tare Leigh Grove, Disfavored Supreme Court Precedent in the Lower Federal Courts, ___ Va. L. Rev. (forthcoming 2026), which introduces a new model for lower courts in the “twilight” of precedent (not overruled but not fully binding).
