S & M and Consent

Courtesy of Dan Levine, faithful PrawfsBlawg reader, comes word of U of C professor Bernard Harcourt‘s new venture, The Carceral Notebooks, Volume 1. It seems he collected the student essays in an advanced Crime and Punishment seminar and published them in this volume; the contents are available here. Generally speaking, the essays look fun. Of particular interest is a nice little article by Naria K. Santa Lucia, who proposes a contractual consent regime for S & M practices, which are sometimes prosecuted under assault statutes that are not amenable to a consent defense.
