I did the “On Point” radio show the other day, with Prof. Larry Tribe and Jan Crawford Greenburg. It was fun, if a bit testy in places. It is fair to say, I think, that the host, Tom Ashbrook was pretty skeptical about my skepticism concerning the claim that the election of Sen. McCain, combined with the retirements of Justices Stevens and Ginsburg, would result in the end of church-state separation, a striking roll-back of individual freedoms, and a dramatic transformation of America and Americans’ lives. (It would result, I think, in a world where Justice Kennedy’s views mattered less, and Chief Justice Roberts’s mattered more, but I think that’s probably a good thing.) You should go to the New York Review of Books site and check out the audio from Ronald Dworkin. Makes it sound as if McCain won America would turn into some sort of evangelical theocracy.
