Glad Talent Wants to be Free resonated and that there is a growing number of important initiatives at the federal – Warren, Murphy, Wyden introduce new bill – and state levels, for example here, to restrict the use of non-competes.

Just correcting mistake in my comment above :
In the Israeli state , it is so indeed , that restrictions are not so severe , and typically may favor the employee , yet , notwithstanding , this is not the main reason for innovation. Rather the army as mentioned , funding by the government , mentality or cultural reasons and more …..

Very interesting , and great luck with that book , but I am afraid , that such approach is not so simple, for too many reasons , and just some few to balance it rather :
The idea that :
” Policymakers need to remove these restrictions: they should presume that free trade in human talent is a good thing unless there are obvious attempts to steal corporate secrets. ”
But such free trade , is that what is causing many times such ” obvious attempts to steal corporate secrets ” otherwise, what shall the employee do with it ?? He would like to move forward , to get promotion in a new position in a new firm.
Beyond it : dedication , loyalty are extremely important . They create confidence . They would enhance long term investments in human resources. If an employer , is aware to such swift shift in positions stemming from free market , why would he trust an employee , and invest on him for the long run ??
Also , such lack of confidence , is causing frequent breaches in privacy of the employee . The employer becomes very suspicious . He may monitor every move of the employee , and take precautions , and ” precede remedy to the malady ” before it would strike him. So , with the electronic means available today , it becomes , massive , intrusive , and with no cost almost .
P.S : In the Israeli state , there are significant restrictions ( contrary to what is claimed in that article in the “Economist ” ) the innovation there , stems mainly from the fact , that the army is huge ( relatively ) and significantly based upon hi tech and innovations, all around so . Not correct at all !!
