A case on the horizon will ask the Court to overrule Plyler. It’s not hard to imagine a state enacting a law restricting illegal aliens from attending K-12 public schools in order to test the validity of that 1982 precedent.
Given that possibility, it’ll be interesting to see if the Court cites Plyler in its Trump v. Barbara opinion. If it does, will any Justices concur separately so as not to endorse Plyler?
