Until the other day, I didn’t know that the District Court and the Circuit Court in Gobitis both ruled for the children and their parents. And the opinions are quite interesting. You can find them at 108 F.2d 683 (3d Cir. 1940) and 24 F.Supp. 271 (E.D. Pa. 1938).
This is part of a project that I’d like to write up someday on: “Lower court opinions that were better than the Supreme Court’s opinion.” One example is INS v. Chadha. Trump v. Anderson is another.
