On their summer vacation, the Justices spoke often about the emergency or interim docket. Three quick reactions:
- CASA strikes me as the right approach. Have an expedited argument that provides time for the Court to write a proper opinion.
- But if that seems too slow, there is the option of issuing a decision with an opinion to follow. This lets the Court issue a quick ruling while taking more time to write opinions.
- Issuing a quick decision with no opinion is the worst of all worlds.
